ZENDA PLATFORM APPLICATION PRIVACY POLICY

Zenda, LLC (“Zenda,” “we,” or “us”) is committed to protecting the privacy of users (“you”) of our web-based platform. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access or use the Zenda Platform, including any pre-release, Alpha, or Beta versions of the platform hosted at www.app.zendaplatform.com. By accessing and using the Zenda Platform application, you agree to the collection and use of information in accordance with this Policy.

1. We may collect the following types of information automatically when you use the Platform: usage data, including traffic data, logs, communication data, and resources accessed; device and browser information such as IP address, operating system, and browser type; and cookies and similar tracking technologies to enhance your experience.

2. The information we collect may be used for, not limited to, the following purposes: evaluating and improving the Platform; ensuring the security and integrity of our services, including account and access authentication; performing diagnostics, debugging, and analysis; identifying usage patterns to optimize the user experience; and feedback integration and product development.

3. You may not use the Platform to collect, upload, store, process, or share any personal, private, or regulated data such as PII, PHI, payment data, or financial information. Violations of this requirement are solely your responsibility and will result in indemnification obligations to Zenda.

4. We implement commercially reasonable security measures. However, since this is a pre-release Platform, we do not guarantee the absolute security of any information. You must notify us immediately if you become aware of any breach or unauthorized access.

5. Cookies and other tracking tools may be used to automatically collect usage data. This includes session cookies for authentication and persistent cookies for remembering preferences. No personal data is collected through these mechanisms. We do not knowingly collect data from individuals under 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us immediately and we will take the appropriate steps to remove such data from our servers. If you are a California resident, you may be entitled to certain data control measures upon request.

6. Any feedback, ideas, or suggestions provided by you in relation to the Platform shall be deemed the exclusive property of Zenda. You agree not to claim ownership or attribution rights.

7. Materials generated on, by, or with the assistance of the Zenda Platform must retain Zenda branding. Any removal or modification of this branding is prohibited and may lead to legal action including injunctive relief.

8. We do not sell, trade, or otherwise transfer your information to outside parties. However, we reserve the right to disclose aggregated, anonymized data for purposes such as research or product improvement. We are not responsible for the privacy practices of outside parties, including integrated or linked third-party services.

9. You agree to comply with all applicable laws and regulations regarding your use of the Platform, including data protection and cybersecurity laws.

10. Since personal data should not be used on the Platform, Zenda does not retain personal data. Zenda retains the information described in Paragraph 2 for the stated purposes. You may request deletion of any incidental data collected. To make such a request, contact Zenda by following the instructions provided in Paragraph 12 herein.

11. We may update this Privacy Policy periodically. Continued use of the Platform after changes are posted constitutes your acceptance of such changes.
